Venue Policies
Service Animal & Animal Safety Policy (ADA‑Compliant) for Jingle Terrace Nights
Purpose
This policy is intended to ensure compliance with the Americans with Disabilities Act (ADA) while maintaining the health, safety, and welfare of guests, service animal handlers, staff, and the animals participating in the petting zoo/event.
Scope
This policy applies to all public areas of the event, including animal interaction areas, staff, volunteers, contractors, and vendors.
1. Service Animals Under the ADA
In accordance with the ADA:
- A service animal is defined as a dog, or in limited cases a miniature horse, that is individually trained to perform specific tasks or work for a person with a disability.
- Emotional support animals, therapy animals, comfort animals, and pets are not considered service animals under the ADA and are subject to standard animal restrictions.
Service animals are permitted in all areas of the event where the public is normally allowed, except where a specific, documented safety risk applies (see Section 4).
2. Verification of Service Animals
Staff and volunteers may only ask the following two questions if it is not obvious that an animal is a service animal:
- “Is this animal required because of a disability?”
- “What work or task has the animal been trained to perform?”
Staff may not:
- Request medical documentation or proof of disability
- Require service animal certification or identification
- Ask about the nature of the person’s disability
3. Handler Responsibilities
Service animal handlers are responsible for:
- Maintaining control of the service animal at all times using a leash, harness, or tether (unless the device interferes with the service animal’s work or the individual’s disability prevents use)
- Ensuring the service animal is housebroken
- Preventing the service animal from interacting with, chasing, barking at, or disturbing the petting zoo animals
Service animals must not be placed inside animal enclosures, pens, or restricted staff‑only areas.
4. Animal Safety & Limited Access Restrictions
The event recognizes that certain animals may experience stress or pose safety risks when in close proximity to dogs or miniature horses. As permitted by the ADA, limited, specific restrictions may be applied only when necessary to prevent a direct threat to health or safety or a fundamental alteration of the program.
Examples may include:
- Enclosures with prey animals that exhibit extreme stress responses to dogs
- Areas housing animals with known aggressive or defensive behaviors
- Situations where biosecurity or animal welfare standards would be compromised
Any restriction will be:
- Based on individualized assessment, not blanket exclusion
- Limited to the smallest area necessary
- Clearly explained to the guest in a respectful manner
When access to a specific animal interaction area is restricted, the event will provide reasonable alternative accommodations, such as:
- Viewing animals from a safe distance
- Staff‑assisted interaction without the service animal entering the restricted zone
5. Removal of a Service Animal
A service animal may only be asked to leave the premises if:
- The animal is out of control and the handler does not take effective action to control it, or
- The animal poses a direct threat to the health or safety of people or animals
If a service animal is removed, staff will continue to offer the individual the opportunity to participate in the event without the service animal present.
6. Staff & Volunteer Training
All staff and volunteers will receive training on:
- ADA service animal requirements
- Appropriate and respectful communication with guests with disabilities
- Animal safety protocols and stress indicators
- Proper escalation to a supervisor if a safety concern arises
Final decisions regarding service animal access restrictions should be made by a designated supervisor whenever possible.
7. Signage & Public Communication
Clear signage will indicate:
- Service animals are welcome under the ADA
- Certain animal areas may have limited access for safety reasons
- Guests should notify staff if they require assistance or accommodations
8. Policy Review
This policy will be reviewed annually and updated as necessary to ensure ongoing compliance with ADA regulations and best practices in animal welfare.
This event is committed to accessibility, inclusion, and animal welfare, and will make every reasonable effort to balance these priorities in a respectful and lawful manner.
